Another Court Upholds Fracking Ban

cornellsun.com -- A New York State Supreme Court upheld the Town of Middlefield’s ban on hydraulic fracturing and gas drilling on Friday, mirroring a decision made Tuesday on Dryden’s hydraulic fracturing ban.

The decisions are widely expected to set a precent for cities and towns across the state that have banned fracking.

Donald Cerio, Jr., Otsego County Acting Supreme Court Justice, ruled that the Town of Middlefield was in compliance with State law when it passed a ban on oil and gas drilling in June, according to court documents.

"Local municipalities are permitted to permit or prohibit oil, gas and solution mining or drilling " Cerio wrote in his decision.

More than 50 New York communities have banned gas drilling, according to The Wall Street Journal.

Their gas should go up to 5.00 gallon till they realize this oil is needed to move forward.

A wise ruling to allow localities to make an important decision on their quality of life. I too prefer safe and clean drinking water.

All things considered, I would rather pay higher gas prices than to to have to drink polluted water due to fracking chemicals.

Although I may not agree on the decision that was made. I believe that states and local governments should churn out these issues. The local people have skin in the game and should be able to decide what they want.

Fracking is safe when done properly and with constant supervision otherwise it is dangerous to lethal to the surrounding population wether human or wildlife!

Sooner or later we will find out if fracking is harmful or not. It just kind of makes sense that if you put something in the ground that is not good for you then you shouldn't do it.

Good. People - in towns at least - should have the right to not have oil wells sitting right on their door steps - especially if they don't own their own mineral rights.

Great! When the oil drillers and big oil; stop acting like the tobacco companies did, and clean up their act, then they will be able to drill and maybe even if they start using better and safer methods be able to use some kind of fracking.
